Terms & Conditions
This website is managed by Kaboo Studio Pty Ltd (“Kaboo Studio”). Terms “we”, “us” and “our” used throughout our website refers to Kaboo Studio. Please read our terms and conditions to ensure you understand our policies and our commitment to you in providing our services.
By you purchasing services or products from us you acknowledge that you have read, understood and accept the terms and conditions. If you are purchasing services or products as a guardian on behalf of children you accept the terms and conditions on their behalf. We reserve the right to change the terms and conditions at any time. The updated terms and condition take effect immediately and form part of our agreement with us. Please read our terms and conditions each time you access our studio or prior to making a purchase in case they have been updated.
By accessing our website and/or purchasing something from us, you engage in our “Service” and agree to be bound by the terms and conditions (T&Cs), including any additional terms and conditions and policies referenced on this page, these include our COVID 19 Customer Policy, our Cancellations and Refund Policy, our Merchandise Returns Policy and our Privacy Policy. These T&Cs apply to all users of the site and in-studio visitors, including without limitation users who are browsers, vendors, customers, merchants and/or contributors of content.
Payment and pricing
We accept payment via our secure payment gateway using credit card (Visa, Mastercard, AMEX).
All pricing is in Australian dollars is inclusive of 10% GST. We reserve the right to change pricing at any time and modify or suspend the sale of any goods or services with or without notice to you.
Exclusive Use, Celebrations, Kids birthday parties
Exclusive use or Paint & Cake bookings at Kaboo Studio are not confirmed until a deposit has been made and we have emailed you with a confirmation of payment receipt. A 50% deposit is required to secure the booking with full payment due at least 14 days prior to your event. There are no refunds for customers who do not attend after final payment is taken (reduction in numbers or no-shows).

Gift vouchers
All gift cards are valid for 3 years from date of issue. These are non-refundable and not able to be converted to cash.
Booking confirmation
You will receive an email booking confirmation after purchase online. This confirmation is evidence of your acceptance of the T&Cs. It will contain details of your booking – date and time, cost and number of participants.
Promotions and competitions
We love a giveaway. If we run a promotion or competition the T&Cs on this website will apply. You accept the T&Cs and any additional terms and conditions which may apply to that promotion or competition by entry into that promotion or competition. By entry you also consent to use of your personal information in accordance with our T&Cs and Privacy Policy.
Under 18
We welcome people of all ages into our studio. You must be over 18 to attend a Kaboo Studio where BYO alcohol applies unless you are in attendance with a guardian over the age of 18.
Up to two children 5 and under are able to participate without charge if sharing paint and a canvas with a full paying customer.
We are not a child-minding facility. Children aged 12 years and under must be supervised by a parent or guardian. If you have children attending any session, we expect you and the little customers will respect others and their canvases, paint and property. We also expect this of any one without children too! No refunds will be provided if you are asked to leave due to unruly behaviour.
Copyright
All paintings, artwork, photos, graphics, text, video clips, audio clips, slogans, icons, trade names, trade marks and all other intangible property, rights in copyright and intellectual property contained on our website and within studio belongs exclusively Kaboo Studio. No permissions are given to use, reproduce, modify, copy, transmit, display, publish, sell, license, distribute or commercially exploit any of the content or otherwise dispose of any of the content in a way not permitted by us, without our express written consent. You are certainly welcome to take selfies in studio and share with your social networks.
Entry to Studio
Personal belongings and clothing
This is a splatter paint studio. Despite your smock or poncho, that you might get paint on your clothes, shoes or in your hair (not often it depends on how enthusiastic you are). We suggest all participants wear clothes which they comfortable with getting paint on. Wear flat shoes - paint gets on the floor. We do not accept responsibility for loss or damage caused to your clothing, footwear or personal belongings.

Respect
Kaboo Studio is an inclusive environment for everyone of all ages and abilities to enjoy. We expect all customers to show respect to all other customers and staff. You may be refused entry or asked to leave if you or your group does not abide by these T&Cs. This may include being under the influence of alcohol or drugs or behaving in an offensive, obscene, threatening or unruly manner towards our staff or other customers.
Whilst we are all about throwing paint at a canvas, please respect our studio and not cause damage.
Personal Responsibility
A reasonable amount of alcohol is permitted to our studio if you are hosting an exclusive session or attending a BYO session. A liquor licence is not required to operate a BYO venue (Liquor Act 2007), however we operate responsibly and expect you consume alcohol in moderation. We prohibit underage drinking. It is illegal for a person to supply liquor and for a minor to drink liquor in a BYO venue.
Security
Security camera and video recording may be in use in Kaboo Studio premises.
Photography
Kaboo Studio may take photos or videos during your session or at a public event where Kaboo Studio has a pop up or live experience or event. If you would prefer we do not capture your image, please let us know before the session commences or at time of booking. We will not take images of children without their parent’s or guardian’s permission.
If you are over 18, by making a booking with us you expressly and impliedly authorise and permit Kaboo Studio to take photos and videos of you including your voice, and to use and reproduce the images and video footage with any words, images or drawings for all business uses including the promotion and advertising for Kaboo Studio.
Disclaimer and limitation of liability
The purchaser agrees that, subject to the following paragraph, the provision of any service, including but not limited to splatter painting sessions, merchandise, purchased from our website and in studio is at the customer’s sole risk. To the full extent permissible by applicable law, Kaboo Studio will not be liable for any damages of any kind arising from the use of this site, or from any services provided from this website or establishment or in studio, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
The purchaser acknowledges and agrees Kaboo Studio’s liability to the purchaser for any claim for loss or damages (including legal expenses) made in connection with these T&Cs whether in contract, tort (including negligence), under statute, in equity or otherwise for any liability for Services not being fit for purpose or otherwise claimed to be defective or deficient is limited to the provision of the Services again or the payment of the price of having the Services provided again, at Kaboo Studio’s election. Where goods and/or services are provided by a third party to you at a session (such as the provision of food or drink to you by your host/a caterer at our studio or a session held at a third party venue) or provided by a third party to you in connection with a session (such as customised merchandise), you acknowledge and agree to hold us harmless and to indemnify us against any illness, injury, damage or loss you may suffer whatsoever arising from or under, related to or connected with the provision of the third party goods and services to you.
Nothing in these T&C’s excludes, restricts or modifies any terms, conditions or warranties or Kaboo Studio’s liability for them which are imposed or implied by any statute, including the Competition and Consumer Act 2010 (Cth), and which cannot be excluded, restricted or modified. Limitations and exclusions are made only to the extent that Kaboo Studio may legally do so.

Allergen Disclaimer
Food
Kaboo Studio offers a BYO Cake and food options for private events which is arranged directly by the host of the private event/celebration. Please speak with your host to confirm any dietary requirements.
Paint and soap
If you are concerned about potential allergies or reaction to paint or soap, we have the ingredients lists available on site at the studio.
